Conveyancing Procedure:

Purchase Property

→ Clients find a property

→ Review the Contract of Sale and advise clients and provide clients with detailed report concerning all aspects of purchase

→ With clients instruction, negotiate the terms and conditions of the Contract with the Owners Solicitor/Conveyancer

→ Contracts are Signed & Exchanged.

→ Related Certificates and Searches are conducted

→ Liaise with clients bank and meet with their requirements

→ Prepare all Transfer related documentation

→ Book settlement in with clients Bank and the Owners Solicitor

→ Prepare settlement adjustment figures and cheque directions

→ Attend Settlement and finalize the matter

→ Congratulations! You are the new owner of the property.

We normally recommend that clients do not enter into a contract unless the following issues have been satisfactory:

  • Contracts have been reviewed by clients independent legal advisor and clients fully understand the terms and conditions of the contract; and
  • Carrying out the relevant inspection of the property, such as building & pest inspection, or strata inspection; and
  • Finance is ready for clients to proceed

Sale Property

Prepare the Contract of Sale in accordance with clients instruction

→ Real Estate Agent finds a buyer, and issue the contact to potential buyer

→ Negotiate the terms of the Contract with the Buyers Solicitor/Conveyancer

→ Contracts are Signed & Exchanged

→ Liaise with clients Bank in relation to payout figures for mortgage

→ Related Certificates and Searches are conducted

→ With client's instruction, answer the Buyers questions about the title of the property

→ Signing of transfer documentation

→ Book settlement in with clients Bank and the Buyers Solicitor

→ Check settlement adjustment figures and prepare cheque directions in accordance with clients instruction

→ Attend Settlement and finalize the matter

→ Property SOLD

Please note that it is essential to have a well-drafted contract ready for exchange to ensure that the vendor's statutory disclosure obligation has been fulfilled to avoid the circumstance that the contract could be void either because of non-compliance with the vendor's disclosure obligation or incomplete contract.
